Privacy Policy.

How Origin Software collects, uses, and protects your information.

Origin Software, Inc. ("Origin Software," "we," "us," or "our") is a California corporation located at 2108 N St #15546, Sacramento, CA 95816. We take your privacy seriously. Please read this Privacy Policy to learn how we treat your personal data. By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and disclose your information as described in this Privacy Policy, to the extent permitted under applicable data protection laws.

For purposes of this Privacy Policy, our "Services" include the originsoftware.net website, our software products (including ViewerFX®, CommissionSpot, CompoundFX, and Retold), our license registration and customer support systems, and related online products and services that link to this Privacy Policy.

Remember that your use of Origin Software's Services is at all times subject to our Terms of Service, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Service.

In the ordinary course of making the Services available we may process personal data about individuals at the direction of our customers. For example, when a CommissionSpot customer's loan officers and operations staff access the platform on behalf of the customer organization, we process that data as a service provider under contract with the customer. In those cases the customer's privacy policy or other agreement between the customer and you or your organization, and not this Privacy Policy, applies to such processing. Where that is the case, please contact the relevant customer, and not Origin Software, in the first instance to address your rights with respect to such data.

As we continually work to improve our Services, we may need to change this Privacy Policy from time to time. We will alert you of material changes by placing a notice on the originsoftware.net website, by sending you an email, and/or by some other means. Please note that if you've opted not to receive legal notice emails from us (or you haven't provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.

What this Privacy Policy Covers

This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Services. "Personal Data" means any information that identifies or relates to a particular individual and also includes information referred to as "personally identifiable information" or "personal information" under applicable data privacy laws, rules or regulations.

When we collect Personal Data directly from you in connection with your use of our websites, license registration, billing, support, or marketing activities, Origin Software is acting as a "controller" (or "business" under certain U.S. state laws). When we process Personal Data that our enterprise customers submit to certain Services—such as commission and compensation data submitted by CommissionSpot customers, or article content submitted to Retold for lens-based analysis—we do so solely on behalf of those customers as their "processor" or "service provider," and our processing is governed by our agreements with them. This Privacy Policy does not cover the practices of companies we don't own or control or people we don't manage.

CompoundFX, our iOS compound interest calculator, is designed to operate without collecting Personal Data. All calculations and saved scenarios are stored locally on the user's device using SwiftData. There are no accounts, no cloud sync, and no analytics. References to "Personal Data" in this Policy generally do not apply to CompoundFX users, except where they otherwise contact us for support or licensing inquiries.

    • Responding to correspondence that we receive from you, contacting you when necessary or requested, and sending you information about Origin Software or the Services.
    • Sending emails and other communications according to your preferences.

Other Permitted Purposes for Processing Personal Data

In addition, each of the above referenced categories of Personal Data may be collected, used, and disclosed with the government, including law enforcement, or other parties to meet certain legal requirements and enforcing legal terms including: fulfilling our legal obligations under applicable law, regulation, court order or other legal process, such as preventing, detecting and investigating security incidents and potentially illegal or prohibited activities; protecting the rights, property or safety of you, Origin Software or another party; enforcing any agreements with you; responding to claims that any posting or other content violates third-party rights; and resolving disputes.

We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated or incompatible purposes without providing you notice or obtaining your consent.

Categories of Sources of Personal Data

  • You: We collect Personal Data that you provide directly to us, for example when you submit the contact form, register for a free ViewerFX® trial license, purchase a paid license, or contact us via support channels. We also collect certain Personal Data (such as Device/IP Data or Web Analytics) automatically when you use our Services, or if you download or install one of our applications.
  • Third Parties such as:
    • Service Providers that provide analytics on how you interact with our Services or that help provide you with customer support.
    • Our payment processor (Wave Apps) for ViewerFX® purchase data.
    • Businesses that you have a relationship with, for example in connection with credentials that you may provide to us in support tickets.

How We May Disclose Your Personal Data

We disclose your Personal Data to the categories of service providers and other parties listed in this section. Depending on state laws that may be applicable to you, certain types of disclosures could in principle constitute a "sale" or "sharing" of Personal Data under the CCPA. However, as described in the California Resident Rights section below, we do not currently sell or share your Personal Data as those terms are defined under the CCPA.

  • Service Providers. These parties help us provide the Services or perform business functions on our behalf. They include:
    • Hosting, technology, and communication providers.
    • Analytics providers for web traffic or usage of the site.
    • Security and fraud prevention consultants.
    • Support and customer service vendors.
    • Email delivery providers (for license keys, support correspondence, and marketing emails).
    • Payment processor (currently, Wave Apps).
    • Cloud infrastructure providers (currently, Amazon Web Services for backend services that support CommissionSpot and Retold).
  • Parties You Authorize, Access or Authenticate. This could include third parties you access or interact with through the Services, customers you access the Services in connection with, and any other third parties you authorize us to disclose Personal Data to.

Legal Obligations

We may disclose any Personal Data that we collect with third parties in conjunction with any of the activities set forth under "Other Permitted Purposes for Processing Personal Data" section above.

Business Transfers

All of your Personal Data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy, or other transaction in which that third party assumes control of our business (in whole or in part).

Data that is Not Personal Data

We may create aggregated, de-identified, or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified, or anonymized data and disclose it with third parties for our lawful business purposes, including to analyze, build, and improve the Services and promote our business, provided that we will not disclose such data in a manner that could identify you. We will not attempt to re-identify any aggregated, de-identified, or anonymized data except as permitted by applicable law.

Tracking Tools and Cookies

The originsoftware.net website may use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, "Cookies") to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, perform basic analytics, and operate and improve our Services. Cookies are small pieces of data—usually text files—placed on your computer, tablet, phone, or similar device when you use that device to access our Services.

We use Cookies that are necessary for the operation of the Services and Cookies that provide us with aggregated usage information. We do not use third-party advertising Cookies or serve interest-based advertisements through the Services.

The CompoundFX iOS app does not use cookies or tracking technologies and does not transmit any analytics data.

Please note that because of our use of Cookies, the Services do not support "Do Not Track" requests sent from a browser at this time.

You can decide whether or not to accept Cookies through your internet browser's settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways. You can also delete all Cookies that are already on your device. If you do this, however, you may have to manually adjust some preferences every time you visit our website and some of the Services and functionalities may not work.

Data Security

We seek to protect your Personal Data from unauthorized access, use, and disclosure using appropriate physical, technical, organizational, and administrative security measures based on the type of Personal Data and how we are processing that data. You should also help protect your data by appropriately selecting and protecting your password and other sign-on mechanisms, limiting access to your computer or device and browser, and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure.

Data Retention

We retain Personal Data about you for as long as necessary to provide you with our Services or to perform our business or commercial purposes for collecting your Personal Data. When establishing a retention period for specific categories of data, we consider who we collected the data from, our need for the Personal Data, why we collected the Personal Data, and the sensitivity of the Personal Data.

In some cases we retain Personal Data for longer if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

For example, we retain Professional Contact Data and License and Account Data for the lifetime of the customer relationship plus a reasonable period thereafter to support warranty, support, and audit obligations. We retain web analytics data for shorter periods aligned with our analytics provider's standard retention practices.

Personal Data of Children

As noted in the Terms of Service, the Services are not intended for users under the age of 18. We do not knowingly collect or solicit Personal Data from children under 18. If you are a child under 18, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 18, we will delete that information as quickly as possible. If you believe that a child under 18 may have provided us Personal Data, please contact us at legal@originsoftware.net.

California Resident Rights

If you are a California resident, you have certain rights with respect to your Personal Data under the California Consumer Privacy Act ("CCPA"), as amended by the California Privacy Rights Act ("CPRA"). This section describes those rights and how to exercise them.

Categories of Personal Data Collected, Disclosed, and Sold

The "Categories of Personal Data We Collect" table earlier in this Privacy Policy describes the categories of Personal Data we have collected and disclosed in the past 12 months. We have not sold or shared (as those terms are defined under the CCPA) Personal Data of California residents in the past 12 months.

Your CCPA Rights

You have the following rights under the CCPA, subject to certain exceptions:

  • Right to Know: You can request information about the categories and specific pieces of Personal Data we have collected about you, the categories of sources from which we collected your Personal Data, the business or commercial purposes for collecting or selling your Personal Data, and the categories of third parties with whom we disclosed your Personal Data.
  • Right to Delete: You can request that we delete the Personal Data we have collected from you, subject to certain exceptions (such as data we need to provide the Services, comply with legal obligations, or detect security incidents).
  • Right to Correct: You can request that we correct inaccurate Personal Data we maintain about you.
  • Right to Opt-Out of Sale or Sharing: You can opt out of the sale or sharing of your Personal Data. As noted above, we do not currently sell or share Personal Data as those terms are defined under the CCPA.
  • Right to Limit Use of Sensitive Personal Information: You can request that we limit our use of any sensitive Personal Information to specific purposes. We do not use sensitive Personal Information for purposes other than those expressly permitted under the CCPA.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

To submit a request, please email us at legal@originsoftware.net. We will respond to verifiable requests within the timeframe required by the CCPA. We may need to verify your identity before responding to your request, which may include asking you to provide additional information sufficient to confirm your identity.

You may also designate an authorized agent to make a request on your behalf. We may require the authorized agent to provide proof of your written permission and may require you to verify your own identity directly with us.

Other State Law Privacy Rights

Residents of certain other U.S. states (including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and other states with comprehensive privacy laws) may have additional rights under their respective state laws, including:

  • The right to access Personal Data collected about you.
  • The right to correct inaccurate Personal Data.
  • The right to delete Personal Data.
  • The right to obtain a portable copy of Personal Data.
  • The right to opt out of the sale of Personal Data, targeted advertising, or profiling.
  • The right to appeal our decision regarding any of the above requests.

European Union, United Kingdom, and Swiss Data Subject Rights

If you are located in the European Union, the United Kingdom, or Switzerland, you have certain rights with respect to your Personal Data under the General Data Protection Regulation ("GDPR"), the UK GDPR, or the Swiss Federal Act on Data Protection, as applicable.

Legal Bases for Processing

Origin Software relies on the following legal bases for processing Personal Data:

  • Performance of a contract: Where processing is necessary to perform a contract with you, including to provide the Services you have requested.
  • Legitimate interests: Where processing is necessary for our legitimate interests, except where such interests are overridden by your interests or fundamental rights and freedoms.

Examples of these legitimate interests include:

  • Providing, customizing, and improving the Services.
  • Marketing the Services.
  • Corresponding with you.
  • Meeting legal requirements and enforcing legal terms.
  • Completing corporate transactions.
  • Consent: In some cases, we process Personal Data based on the consent you expressly grant to us at the time we collect such data. When we process Personal Data based on your consent, it will be expressly indicated to you at the point and time of collection.
  • Other Processing Grounds: From time to time we may also need to process Personal Data to comply with a legal obligation, if it is necessary to protect the vital interests of you or other data subjects, or if it is necessary for a task carried out in the public interest.

EU, UK, and Swiss Data Subject Rights

You have certain rights with respect to your Personal Data, including those set forth below. For more information about these rights, or to submit a request, please email us at legal@originsoftware.net. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  • Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data.
  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data.
  • Erasure: You can request that we erase some or all of your Personal Data from our systems.
  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.
  • Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
  • Objection: You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes, such as for direct marketing purposes.
  • Restriction of Processing: You can ask us to restrict further processing of your Personal Data.
  • Right to File Complaint: You have the right to lodge a complaint about Origin Software's practices with respect to your Personal Data with the supervisory authority of your country or EU Member State. Transfers of Personal Data

The Services are predominantly hosted and operated in the United States ("U.S.") through Origin Software and its service providers, and if you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside. By using the Services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to Origin Software in the U.S. and may be hosted on U.S. servers, and you authorize Origin Software to transfer, store, and process your information to and in the U.S., and possibly other countries. In some circumstances, your Personal Data may be transferred to the U.S. pursuant to a data processing agreement incorporating standard data protection clauses.
